The Minister of Solid Minerals, Dele Alake, has issued a warning to governors, stating that they do not have the authority to ban mining activities within their states.

Alake emphasized that mining is the sole responsibility of the Federal Government, as stated in the Constitution. He compared a state attempting to regulate mining to a state banning oil exploration, which he deemed illegal.

Alake expressed his concern over the states’ bans on mining activities, emphasizing that it is a constitutional matter.

I would like to take this opportunity to emphasize that no state, and I mean no state, has the power to intervene in mining operations. It is crucial to understand that this is not an arbitrary statement, but a constitutional matter.

According to the Constitution, mining is solely under the jurisdiction of the Federal Government. It falls under the exclusive legislative list, not the residual or concurrent lists.

This means that the authority to regulate and oversee mining activities rests only with the Federal Government. It is important to note that every item on the exclusive legislative list belongs solely to the Federal Government.
